1. Acceptance of Terms

Kavio is operated by XRETAIL. By accessing or using Kavio ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Kavio is a social media scheduling and management platform that allows users to create, schedule, and publish content across multiple social media platforms from a single dashboard. The Service includes AI-powered content generation, team collaboration tools, analytics, and a visual content calendar.

3. Account Registration

You must create an account to access most features of Kavio. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and up-to-date account information
  • Notifying us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Post spam, unsolicited, or harassing content
  • Infringe on the intellectual property rights of others
  • Distribute malware, viruses, or other harmful code
  • Impersonate any person or entity
  • Engage in any activity that disrupts or interferes with the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to send content that violates the terms of any connected social media platform

5. Subscription and Billing

Kavio offers both free and paid subscription plans. By subscribing to a paid plan:

  • You authorize us to charge your payment method on a recurring basis
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel your subscription at any time from your account settings
  • Refunds are handled under our Refund Policy
  • Prices may change with 30 days notice to active subscribers

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using Kavio, you consent to the collection and use of information as described therein. We take the security of your data seriously and implement industry-standard safeguards.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by XRETAIL and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of all content you create and publish through Kavio.

By using the Service, you grant XRETAIL a limited, non-exclusive license to process and transmit your content solely for the purpose of providing the scheduling service.

8. Third-Party Services

The Service integrates with third-party social media platforms (Facebook, Instagram, X/Twitter, LinkedIn, TikTok, YouTube, Pinterest, Threads, Mastodon, Bluesky, and others). Your use of these platforms is subject to their respective terms of service and privacy policies. XRETAIL is not responsible for the actions or policies of these third-party platforms.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses.

10. Limitation of Liability

To the maximum extent permitted by applicable law, XRETAIL and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration or in the courts of the jurisdiction where XRETAIL operates.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification at least 14 days before changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
